After RTFA'ing your link, I may be too stupid as well. According to the article, Clarke claimed "sole responsibility" for approving the flights carrying bin Laden's family weeks after indicating to the 9/11 Commission he left the decision to the FBI (who denies authorizing the flight). It doesn't sound like anything has been properly resolved here.
Regardless, the general secrecy of the DOJ is disturbing, and this case in particular seems a particularly clumsy attempt to prevent access to the data.
