Software patent rights themselves are something very new. It is dangerous to equate these new rights with any old rights covering different types of technology. The American Constitution does not give people ownership of abstract ideas, and even patents until now have been restricted to more concrete inventions.
Software Patents are currently a very American thing. We don't yet have them in Europe, despite America's best efforts. I believe that any country that doesn't follow America stands to benefit from improved software innovation, allowing America to stand on its own and sink into its own patent mess.
