You can also get it under Java Research License (JRL). Not an open source licence too but why do we need an open source Java?
Most developers don't look at the source (except maybe from src.zip).
Most people who look at the source don't change anything, so for that people the JRL should be good enuff.
And there are allready open source implementations
like gnu classpath, which is 71.72% compatible with 1.4.
