Strike two.
You have missed the point also. Apache's OSS implementation will not perform better than Sun's, and they know this. Sun's version has a 10 year headstart on maturity. OSS developers will not be able to make up on this kind of lost time. Where the OSS version will be most valuable, is the fact that it will be released under a Free license. Currently, Sun, theorectically, could stop offering their JVMs and class libraries for free, and set an arbitrarily high price tag. Anyone that already has Java applications running would suddenly be caught between a rock and a hard place. If this were to ever happen, Apache's (not as good as Sun's) version would be "good enough" to save the day.
