I'm no expert on Breathalyzer's, but I'd assume it probably operates on some basic microchip like a PIC controller, which is the source code in question. If so, isn't there a possibility of pulling the chip out of the device, and hooking it up to a computer, dumping a binary onto the computer, and then disassembling that binary? If so, and one happened to find a bug in the code detrimental to the affectiveness of the device, would it be possible to use that as evidence in court, even though the code is a trade secret?
Also, if the company is refusing to release the source code, wouldn't the state be obligated to release all charges in any past case against someone that was tested with one of these devices?
