Sleepycat GPL

If someone took the GPL-ed Sleepycat and modified it, sent the mods to Sleepycat but released it as, say, Jumpydog wouldn't that get them out of it altogether? Jumpydog could branch from Oracle if it did not like the way it was going. Using Jumpydog would not have Corporate bias (i.e., no corporate use fee).
