Nobody claimed the viral code was fixed, rather that the kernel was patched (fixed) to allow the viral code to run. As far as gcc is concerned, perhaps you know it and the kernel well enough to contradict Torvalds, but I sure don't. He is pretty clear in his description of events, and gives example code generated by gcc to back it up.
