It's truly a shame that people 'dilute' the intensity of their claims by making all sorts of 'sidal' arguments. While the GPL should clearly lead to damages being paid, the whole copyright issue just hurts the credibility of the plaintiff. This is not about art. It is about code misuse. That -- and that alone -- should matter here. The GPL has already won in the Germany courts, FWIW, so this isn't unprecedented.
