"Congress shall make no law..." The First Amendment is not binding upon any other party.
Free thought, free speech, free press, and free assembly can be negotiated, and are all the time. When you begin working at a new job, you often must sign an agreement stating you will not speak or act in public against the interests of your employer. This is an abridgment of Free Speech via contract law, not criminal law.
