I'm guessing their straightforward approach will be finding an obviously bad software patent from a mediumly warchested but somewhat well known company, and challenge its validity... get the direct and true issue into the spotlight. By only defending against patent infringement suits, you only seem to be fighting whether or not you infringed, not on the validity of the patent in the first place. Too many media sources choose their headlines to sound like dramatic reality-TV conflicts (aka petty personal disagreements), so don't give them the chance of writing headlines about this effort being a "mine vs yours" fight.
Based on those results, either continue challenging similar bad patents from similarly sized companies, or look larger. I fear a mistake would be to target a huge warchested company with means to out-litigate even governments, which would prevent the end to a fight from ever coming... look how long it took to get where we are with SCO.
I don't think it's necessary to "pick a fight" by intentionally violating a known patent just for the sake of the patent holder initiating the fight. MS is showing that just talking about the fight is a good enough strategy for them at the moment.
