Kelly McNeill writes “The Microsoft antitrust decision is still intact after the first appeal. What does this mean for the future of Microsoft’s “The Freedom to Innovate” theme? At first glance, the opinion handed down by the appeals court looks like a victory for Microsoft. e most important aspect to the appellate decision is that the trial court’s findings that Microsoft is a monopoly and abused its monopoly power have been upheld. What has been affected is the remedy. This does not mean that the remedy is set aside or reversed. What it means is that it must be reconsidered by another court. This reconsideration could go either way.”
